Terms of Service

Overview

This website is operated by aGuyWithMSthatDraws. These terms apply to purchases through this website. Please also review the Return and Refund Policy, Shipping Policy, and Privacy Policy.

Products and Appearance

I strive to accurately represent all artwork and products. Screen settings, photography, and the handmade nature of artwork may result in slight differences in perceived color or texture.

The product description identifies the size, materials, framing, and other features included in your purchase. Normal variations do not include damage, manufacturing defects, or material differences from the description.

Original Artwork

Purchasing an original transfers ownership of the physical artwork only. Copyright and reproduction rights remain with the artist behind aGuyWithMSthatDraws unless expressly transferred in writing.

Original artwork includes a Certificate of Authenticity. If yours is missing, please contact me.

Limited Edition Prints

Edition limits apply to the specific size, paper or media, and edition identified in the listing. That edition will not be expanded beyond its stated limit.

The same artwork may be offered separately in other sizes, papers, media, or product formats. These versions may differ in appearance and are not part of the numbered edition you purchased.

Copyright and Permitted Use

Purchasing artwork, prints, or merchandise does not grant permission to reproduce or commercially use the design.

Except where permitted by law, you may not reproduce, scan, redistribute, create merchandise from, trace for resale, or otherwise commercially exploit the artwork without prior written permission. No permission is granted to use the artwork to train artificial intelligence systems or to create NFTs or other tokenized assets.

Personal photographs of your purchased artwork are welcome for personal, noncommercial use, including sharing on your personal social media. Advertising, promotional use, and other commercial uses require prior written approval.

Product Images and Mockups

Some listings include digitally staged or AI-assisted mockups to help illustrate how a product may look when displayed or worn.

Frames, furniture, props, and other staging accessories are not included unless the product description expressly says otherwise. Refer to the listed dimensions for actual size.

Mockups are illustrative. The product description and actual product photographs, when available, take precedence over staged images.

Merchandise

Print-on-demand merchandise is produced to order. Minor variations in print placement, color, or manufacturing may occur, but damaged, defective, or incorrect products will be addressed under the Return and Refund Policy.

Please review the product description and size chart before ordering.

Orders and Cancellations

Please provide accurate contact and shipping information when placing your order.

Cancellation requests must be emailed to aguywithmsthatdraws@gmail.com within 24 hours of purchase. Cancellation can only be approved if production or shipping has not begun. Submitting a request does not guarantee cancellation.

Approved cancellations will be refunded to the original payment method.

Returns, Order Issues, and Shipping

All sales are final except for damaged, defective, or incorrect items, or where otherwise required by law.

Please report order issues within 7 days of delivery and include your order number, a description of the issue, and clear photographs of the item and packaging. Keep the item and packaging until the issue is resolved, and do not return anything without instructions.

The Return and Refund Policy explains replacements, refunds, and return shipping. The Shipping Policy explains processing and delivery. Those policies govern their respective subjects if a summary in these terms differs.

Pricing and Listing Errors

If a pricing or listing error affects your order, I’ll contact you. Where permitted by law, I may cancel the affected order and refund all amounts paid for it. I will not charge a higher price without your agreement.

Commissions

If custom commissions are offered, separate written terms will be provided and agreed upon before work begins.

Artist’s Use of Artwork Images

Unless otherwise agreed in writing, I retain the right to reproduce, archive, publish, and promote images of my artwork, including sold originals.

This does not grant access to artwork in your possession or permission to publish your personal information or photographs you own.

Limitation of Liability

To the extent permitted by applicable law, my liability for a claim arising from a purchase is limited to the total amount paid for the affected order.

This limitation does not apply to fraud, willful misconduct, or any liability or consumer remedy that cannot legally be excluded or limited.

Governing Law

These terms are governed by Ohio law, subject to any mandatory consumer protections that apply where you live.

Where permitted by law, disputes will be brought in courts of competent jurisdiction in Ohio. This does not limit any right you have to bring a claim in another jurisdiction under applicable law.

Consumer Rights

Nothing in these terms limits statutory cancellation, return, refund, or other consumer rights. Where applicable law provides additional protections, those protections take precedence.

Changes to These Terms

Updated terms may be posted on this website. Changes will not retroactively reduce the rights associated with an order already placed.
